TERMS & CONDITIONS of the Polish language courses organized for foreigners applying for a visa to the territory of Poland

§ 1 Enrollment
1. The conditions below set out the Terms and Conditions of the relationship between the Student and the School.
2. Students must be over 18 years old.
3. An application form must be completed.
4. An up to date passport must be provided.
5. Students must update School with any changes to visa status, arrival times or other information that may affect the expected start date.
6. It is the responsibility of the student to apply for the correct visa and submit the correct documents. School cannot be responsible for any visa refusal.
7. All students must contact School at least 2 weeks before the start date agreed on their letter of acceptance. Failure to do so may result in the student losing their place at School.
8.Students are obliged to inform the School in writing of any medical problems, issues or allergies they may suffer from at the time they apply. The School reserves the right not to allow on the course a student suffering from any illness, medical condition, or mental or physical disability which has not been disclosed.

§ 2 Registration and Conclusion of Contract
1. Registration form is to be completed for each course. With his/her registration, the student acknowledges and accepts the TERMS & CONDITIONS of the Polish language courses organized for foreigners applying for a visa to the territory of Poland
2. After enrolling in the course, the participant is sent confirmation of registration by School in the selected course.
3. An invoice is forwarded with the enrollment confirmation of registration, informing the Student of the payable course fees and indicating the payment deadline.
4. The contract between the Student and the School becomes effective as soon as the School confirms the registration in writing, by letter or email.

§ 3 VISA

2. Decision on language course selection should be made minimum 3 months prior to a starting date of a chosen course so that visa-related procedures can be completed on time. Letters and application forms (except for scan passport with personal details, without payment receipts) sent 3 weeks prior to commencement of a given language course type will not be considered as it is impossible to get a visa in such a short period of time.
3. On selection of a given course type one should fill in the application form carefully and send required documents together with a copy of a bank transfer payment receipt related to the chosen type of a language course to the address of the School.
4. In order to provide the letter of acceptance required by the embassy for issuing a visa, 50% of the total amount should be paid together with an additional charge of non-refundable 200 PLN, non-refundable shipping fees may apply.
5. On receipt of the information that the payment for a chosen type of a language course has been made and that the money is already on the School bank account the School sends its letter of acceptance for a given language course type.
6. School does not send any letters of invitation for its language courses. Each participant may apply for a visa on the basis of obtained written letter of acceptance mentioned above.
7. Polish law will always take precedence and the School is not permitted to offer advice on visa applications. The School accepts no responsibility or liability for any decisions made by embassies or immigration officials regarding the granting, refusal or extension of visas. On arrival at the School, all students must present their passports to check they have the appropriate visa and right to study.

§ 4 Prices and Terms of payment
1. Course fees include:
a) Polish language lessons, b) Placement test, c) Certificate of attendance, d) Additional classes (such as conversations, workshops), e) all teaching materials.
2. The price of the course will not be changed during the course.
3. The participants are required to pay for the whole course in advance or to pay in instalments:
a) prepayment for the entire course of study + registration fee (100 PLN) should be paid within 7 days after the registration.
b) in 2 instalments. The first instalment, which includes 50% of the course fee + registration fee (100 PLN) should be paid within 7 days after the registration. The remaining amount should be paid within first week of the course.
5. The final reservation of spot in a group takes place after the payment has been made.

7. All bank charges related to the payment of the course fee shall be borne by the course participant.
8. If the School does not receive the payment of the course fees by the due date, the Student will no longer be entitled to the services booked. In this case the School is entitled to make the services available to other interested parties.
9. In case of delay in payment of fees, the School will add interest charges up to a maximum specified by Polish law, calculated on an annual basis to the date of actual payment for each day of delay in payment. In case of delay in payment of more than 30 calendar days the School may cancel the Course with the Student retaining the right to claim the fee amount calculated pursuant, including interests.
10. In case of the 1-month or longer payment delay of the whole or part of the School Fee or of other payments to the School, the Student agrees to increase the due amounts by the costs of actions aimed to recover the above receivables, including by the costs of vindication.
11.The Student declares, that he/she is aware, that the potential debts may be transferred by the School to the vindication company.

§ 5  Changes to course booking
1.In exceptional cases participants may change the services booked (e.g. the course date) in consultation with the School.
Any change (e.g. arrival date, etc.) required up to 4 weeks before departure will incur a fee of 150 PLN of administrative fee.
2. Afterwards we will do our utmost, but cannot guarantee the fulfillment of the request made since extra costs may be incurred.

§ 6 Cancellation and Termination by the Participant. Refund policy
1. The Student can cancel the course organized for foreigners applying for a visa to the territory of Poland, after receiving the letter of acceptance subject to the following conditions.
1.1 In case of cancellation no later than four weeks prior to the start of the course, the School will withhold an administrative fee of 200 PLN , and additional postage costs (e.g. DHL), bank charges, if required
1.2 In case of cancellation no later than two weeks prior to the start of the course, School will withhold an amount equal to 30% of the course fee, but not less than the administrative fee of 200 PLN , and additional postage costs (e.g. DHL), bank charges, if required
1.3 In case of cancellation no later than one week prior to the start of the course, School will withhold an amount equal to 50% of the course fee, but not less than the administrative fee of €200 PLN, and additional postage costs (e.g. DHL), bank charges, if required.
1.4 In case of withdrawal after the start of the course, School will withhold 100% of the course fee.
2. Notice of cancellation or termination must be submitted in writing to School sent a scanned copy by e-mail to the address of the school: biuro@svschool.pl. The cancellation date is defined as the date of receipt of the cancellation declaration at the school’s address/email.
3. Refunds can only be made if the school receives the original confirmation of acceptance to this course. Original documents must be delivered to the school address: 00-564, Warszawa, ul.Koszykowa 10, lok.4
4. If the refusal to execute the Agreement relates to participation in a course organized for foreigners applying for a visa to the territory of Poland, in case of obtaining a visa of Students who have received confirmation of their participation in the course, the cost of the resignation is 100% of the cost of the course.
5. The payment for the course is not refundable (in case of resignation) for the citizens of the countries with a visa-free regime with Poland who have received confirmation of their participation in the course on the basis of which they can obtain a visa.
6. Cancellation of the language course after receipt of the visa is only possible when supported by documentation from the Polish embassy proving that the participant has not entered Poland. If the participant has already entered Poland, cancellation of the course is no longer possible.
7.Termination and cancellation are excluded if more than six weeks have elapsed since the reason for the termination or cancellation.
8. The School is under no obligation to refund any tuition fees on the basis of Student’s absence.
9. The course starting date is decisive for termination and cancellation notice periods for courses.
10. All the refunds will be processed within 90 working days from the date the refund has been requested provided the student has submitted the following information required to process a bank transfer:

Address of the account holder
Bank name and branch address
11. No refund of tuition fees will be given if a student has commenced their course and is dissatisfied with the allocated level of study.
12. Each person who turns to the School with a request to be refunded will be asked to provide additional information and documents explaining the reason(s) behind his / her decision to give up studying on the Regular Polish Course. This will refer to those people who do not commence studying due to „Force Majeure” related reasons (i.e. illness of a family member). This information should be sent to the school at least 2 weeks before the course starts. Otherwise, the fees won’t be refunded.
§ 7  Visa Refusals
1. In case the visa that allows Student to enter Poland for a language course organized by the School is not issued, the School will refund the amount paid for the course, less costs incurred, such as postage costs (e.g. DHL), bank charges and an administration fee of 200 PLN.
2. The school must be notified of any cancellations at least 2 weeks before the start of the course before any refunds will be considered. An administrative charge of 200 PLN will always be charged. If the school is not notified in the expected time period we deduct 2 week tuition from any agreed refunds and a 200 PLN administrative charge and additional postage costs (e.g. DHL), bank charges, if required.
3. Refund is made only by bank transfer. The Student is obliged to write a resignation form and present a document confirming the Consulate’s negative decision to issue a visa (a copy of the original document given by the Embassy explaining why your visa has been rejected).
4. Procedures related to a payment refund are specified in each course description. Underlying formal procedures may last from 3 up to 13 weeks from the day the School receives a refund email together with the set of required documents.
5. Refund can be made only when the School receives the original of the confirmation of admission for a given language course type and the information from the relevant consulate on refusal to issue a visa.
6. The school has the right to ask for documentary evidence before issuing a refund – Visa refusal, medical reports or other relevant documentation resulting in the need for cancellation.

§ 8 Attendance, punctuality and absenteeism
1. The School does not reimburse any payments for absences.
2. If the classes had been canceled because of the problems of the School (teacher’s illness, technical issues, etc.), the School organizes a substitution or the classes are postponed to another date that is suitable for all the participants.
3. Timetables are set at the sole discretion of the School and may be subject to change and the Student accepts same.
4. There is no obligation on the School to reschedule classes or to organise any additional classes to make up for any classes the Student has missed and the Student accepts same.
5. The class teacher is responsible for maintaining the register of students. The attendance is marked at the beginning of each class. The class teacher signs the register and records the number of students attending the class.
6. Students are expected to be in class on time, however, there is a 15-minute grace period where students are permitted to enter the class. After the grace period, students may not be permitted to enter the class at the teacher’s discretion.
7. Students who are sick must e-mail or phone the school to inform them that they cannot attend. When the student returns they should present a doctor’s certificate if they have missed more than 6 days. The student will be still marked absent for the period they did not attend classes due to sickness. However, failure to present a doctor’s certificate for an absence of more than 6 days may result in a disciplinary action taken against them.
8. The school may inform the Ministry of Foreign Affairs ( MFA) regarding students’ attendance if Students are frequently absent and do not provide a doctor’s certificate or other good reason. This may affect student’s visa status.
9. The school recommends that all the students attend all scheduled classes. Continued and persistent absence is detrimental to the integrity of the course and the intended learning outcomes. The required minimum attendance rate is 75%, moreover, Non-EU students have a statutory requirement to attend at least 75% of their course. The school reserves the right to take a disciplinary action against a student whose attendance falls below 75%, which may result in expulsion.
10. The school can inform MFA of the expulsion. This may affect student’s visa status.
11. Expelled students are not permitted to apply for readmission to the school and they will not receive any refund of unused fees.
12. The School will only issue a completion certificate if attendance and performance has been satisfactory in the School’s opinion.
13. There are no classes held on Polish public holidays.
14. Non-EEA yearlong students have to apply for their holidays before commencing their course.
15. No unscheduled breaks are permitted except in documented cases of illness, close family bereavement or court appearance. In such cases, the student is required to apply for the unscheduled break in writing to the School, clearly state the duration of the required break and submit any relevant documentation.
16. All the correspondence and documentation relating to unscheduled breaks taken by non EU students will be kept and MFA can be notified.

§9  Organizational ground rules
1. Referring to Course, it is considered a certain amount of classes which are conducted by a teacher/-s in a certain period individually or in a group.
2. Courses are executed at all levels of teaching from A0 – C1 in accordance with a program provided by the Contractor.
3. “Lesson hour” refer to a 45-minute period of instruction.
4. The enrollment for the course is made by filling in the application form (on-line or at the office) and transferring the fee of the course.
Submitting the registration form, paying the fee and receiving a confirmation results in the acceptance of this statute. The statute is constituent of the agreement, which is concluded with every student during the enrollment.
5. To define the language level of the student it is essential to complete a test and go through an interview with a teacher (this does not apply to those who begin the study of the Polish language for the first time).
The groups are formed with taking into account the language experience, age and individual needs of the participants.
6. A course can be opened when a minimum of 6 persons apply for it. The Contractor may decide to begin a course when less than 6 people apply for it. In case of a group consisting of 2 to 5 students, the number of lesson units is reduced.
If the number of students in a group reduces to one or three students only, the course shall be converted into individual Polish classes. The number of lessons will be adequately shortened in accordance with the price of individual Polish classes.
7. In case a previously planned group cannot be launched because of insufficient number of participants, the Contractor shall postpone commencing the course or reimburse the Student with the fees payed before the Course.
8. Once the course has started, in case the number of participants reduces (to less than 6 people), the School will suggest either another group on the same level, a smaller number of classes or the reimbursement of the paid fee, subtracting the number of classes that the student already had.
9. The Contractor reserves the right to enroll new students to the group, but no more than maximum 12 persons.
10. The course ends with a test that verifies the progress of each student. A positive result (61 % and higher) qualifies the student to the next level.
11. At the end of each course, the Student will receive the Course completion Certificate.
12. The students who did not complete the course will not obtain the Course completion Certificate. In a similar case, on the student’s request the School can sign a certificate of attendance.
13. In case of any suggestions or remarks please contact your teacher, the office or the management.
14. In case of need, the School reserves the right to the change of teachers during the course due to important organization issues.
15. The organizer is not incurring liability for any losses of property occurred during the classes nor for accidents and injuries not related to the classes.
16. Underage students are required to provide a written consent of a parent or legal guardian to participate in the course and / or in the cultural programme.
17. The School reserves the right to use the photos made during the classes for marketing purposes.

§10 Rights and responsibilities of the School.
1. The School shall perform the Course with due diligence. The School shall ensure the highest quality of learning by engaging highly qualified teachers with proper methodological and linguistic skills.
2. Classes will be conducted by a teacher appointed by the School before the beginning of the Course. If the teacher is unable to conduct classes, the School will appoint a substitute teacher with similar qualifications.
3. The School shall impose quality control measures as well as visitations to selected classes.
4. In case of need, the School reserves the right to the change of teachers during the course due to important organization issues.

§11 Rights and responsibilities of the Student
1. The Student is obligated to act and comply with the provisions of the herein Agreement and School’s Terms and Conditions.
2. The Student ought to bare in mind, that only regular participation in classes, engagement and preparation for classes and tests shall bring about a successful learning experience and allow the proper execution of the Contract.
3.The Individual classes can be cancelled or put off.
4.If the class was cancelled or rescheduled by the Student via phone or e-mail no later than 4 p.m. on the working day preceding the day when the class is to take place, the course credit does not expire.
5. In the case of the Student’s absence from classes on a given day, with the fault laying on the Student, and if the classes have not been properly cancelled or postponed, the fee for the day is not refunded and the class hours are lost.
6. The Student acknowledges that in the event that the Student is late for a lesson, the lesson will end according to the pre-determined, regular plan.
7. In case of a justified suspicion that a student is under the influence of alcohol or other drugs, they cannot take part in classes.
8. Underage students are required to provide a written consent of a parent or legal guardian to participate in the course and / or in the cultural programme.
§12 Events outside the School’s control
1. The School will not be liable or responsible for any failure to perform, or delay in performance of, any of its obligations in relation to the Student’s Course or Accommodation that is caused by events outside the School’s reasonable control (Force Majeure Event)
2. A Force Majeure Event includes any act, event, non-occurrence, omission or accident beyond the School’s reasonable control and includes, in particular (without limitation), the following:
3. Strikes or labour disputes;
4. Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whher declared or not) or threat or preparation for war; or
5. Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster; or
6. Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;
7. Impossibility of the use of public or private telecommunications networks.
